Preserving Your Right to Grieve on Pay Implementation

The AJC is aware of difficulties in implementing the pay provisions in the collective agreement. Rapid and accurate implementation by the Employer of these provisions remains a top priority for the AJC. In order to preserve your rights, please read the following information carefully.

 

One or more of the following events may have occurred to LP compensation in recent weeks: 

  • Lump Sum Payment / Signing Bonus of $2500
  • Retroactive Pay
  • Salary or Step Adjustment 

 

Many AJC members have advised that they have either not received the lump-sum and/or have had their retro-pay or salary adjustment inaccurately calculated.

 

Lump Sum Payment / Signing Bonus of $2500

To be eligible for the $2500 payment, you must be an AJC member as of May 3, 2024. Most AJC members received their one-time pensionable lumpsum allowance of $2500 in their pay on July 31, 2024. 

 

ACTION: If you have not received the lump sum payment, you believe you were eligible to receive it and would like to file an individual grievance, go to the AJC website prior to September 5, 2024 and fill out an Intake Form. Please ensure to include your mailing address, your LC’s contact information i.e. full name and email address, within the Intake Form.

 

While TBS asserts that the time limit of 25 business days to file a grievance begins as of July 31, 2024, the AJC disagrees and will be contesting this. However, out of an abundance of caution, we advise members to file an individual grievance prior to September 5, 2024 to avoid issues related to time limits and to preserve your rights. Members should also contact the compensation services of your department or Pay Centre Client Contact Centre to obtain a rationale for why you were not paid a lump sum.

 

Retroactive Pay and/or Salary or Step

Some AJC members have received retroactive pay and/or have had their salary and step adjusted in GCPay or by the compensation program used by their department. Several members have informed us that they believe the amounts are inaccurate. 

 

ACTION: If you have received retroactive pay and/or a salary adjustment, you believe they are inaccurate and would like to file an individual grievance, go to the AJC website and fill out an Intake Form. Please ensure to include the date you were notified by either the Pay Centre or Compensation Services that you received retroactive pay or a salary adjustment, your mailing address, yourr LC’s contact information i.e. full name and email address, within the Intake Form.

 

While TBS asserts that the time limit of 25 business days to file a grievance begins as the date the member is notified by the Pay Centre or Compensation Services of their retroactive pay or change in salary, the AJC disagrees and will be contesting this. Again, out of an abundance of caution, we advise members to file an individual grievance within 25 business days of receiving their retroactive pay and/or salary or step adjustment if they believe the amount is inaccurate. By way of example, 25 business days from the August 14 pay is September 19, 2024. 

 

Based on Schedule E of the Collective Agreement, you are entitled to a detailed breakdown of the retroactive payments received and the calculations involved in placing you at a particular step. Contact the compensation services of your department or Pay Centre Client Contact Centre to obtain this detailed breakdown and to verify the calculation of retroactive payments where you believe these amounts are incorrect.

 

Manual interventions on calculations 

Schedule E of the Collective Agreement gives the Employer 180 days to process retroactive payments from May 3, 2024, provided no manual intervention is required. If manual intervention is required, then the Employer has 460 days for implementation. TBS’s position is that most retroactive payment calculations require manual intervention due to the complexity of the calculations in the collective agreement.

 

The AJC does NOT have access to your employment pay records. That information can only be provided to the AJC by you. Therefore, we recommend you contact the Pay Centre Client Contact Centre, or your department’s compensation services.

 

The AJC is actively pursuing these issues regarding pay implementation with the Employer as our top priority. We will continue to keep you updated on any progress or new information we receive.
